1. Introduction
Welcome to Xerosp4ce.com.
Xerosp4ce ("I", "me") operates Xerosp4ce.com and I make game applications exclusively through Itch.io.
My Privacy Policy governs your visit to Xerosp4ce.com as well as any application, programs, or games developed by Xerosp4ce, and explains how I collect, safeguard and disclose information that results from your use.
I use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in my Terms and Conditions.
My Terms and Conditions (“Terms”) govern all use of my Service and together with the Privacy Policy constitutes your agreement with me (“agreement”).
2. Definitions
SERVICE means the Xerosp4ce.com website operated by Xerosp4ce or any other application (game) of mine that links to this privacy policy.
PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in my possession or likely to come into my possession).
USAGE DATA is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit or how many times you launch a particular game).
COOKIES are small files stored on your device (computer or mobile device).
DATA CONTROLLER means a natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be, processed. For the purpose of this Privacy Policy, I am a Data Controller of your data.
DATA PROCESSORS (OR SERVICE PROVIDERS) means any natural or legal person who processes the data on behalf of the Data Controller. I may use the services of various Service Providers in order to process your data more effectively; specifically Itch.io and Epic Games.
DATA SUBJECT is any living individual who is the subject of Personal Data.
THE USER is the individual using my Service. The User corresponds to the Data Subject, who is the subject of Personal Data.
3. Information Collection and Use
I may collect several different types of information for various purposes to provide and improve my Service to you. My games may collect data from Epic Games services, however they do not transmit that data to my servers. Games may transmit information to Epic Games only as needed for functioning of features such as multiplayer, cloud saves, in-game achievements, etc. Games may store preferences that you set locally or your device. If you want to remove that data, simply uninstall them game from the Itch.io launcher or delete the game from your device.
4. Types of Data Collected
Personal Data
While using my Service, I may ask you to provide me with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number
- Address, Country, State, Province, ZIP/Postal code, City
- Cookies and Usage Data
I may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from me by following the unsubscribe link.
Usage Data
I may also collect information that your browser sends whenever you visit my Service or when you access Service by or through any device.
This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of my Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access Service with a device, this Usage Data may include information such as the type of device you use, your device unique ID, the IP address of your device, your device operating system, the type of Internet browser you use, unique device identifiers and other diagnostic data.
Application Data
If you use my application(s), I also may collect the following information if you choose to provide me with access or permission:

Epic Account Data. I don't store your Epic Account data on my servers. If you log into my applications with your Epic Games account then Epic Games may share and I may gain access to specific user data; however, your data remains within the Epic Account ecosystem. My games may access your Epic Account username and ID, game play statistics such as number of times launched, time played, your online presence, and your friends who also have the same game(s). My games can't see your entire friends list. In-game chat (if available) is never recorded by the game.

Mobile Device Data. I automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server). If you are using my application(s), I may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, and information about the features of my application(s) you accessed.

Personal Computer Device Data. I automatically collect device information (such as your device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model, Internet service provider, and Internet Protocol (IP) address (or proxy server).

Game Play data. Game play data is information about number of times the game is launched, length of play sessions, and similar metrics. Game play data is collected and stored in the Epic Games service ecosystem. I do not transfer game play data out of the Epic Games ecosystem. I do not collect game play chat logs.
This information is primarily needed to maintain the security and operation of my application(s), for troubleshooting, and for my internal analytics and reporting purposes.
Tracking Cookies Data
I use cookies and similar tracking technologies to track the activity on my Service and I hold certain information.
Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze my Service.
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of my Service.

I do not use advertising cookies or any third party tracking cookies.
Third-Party Media Accounts
My Services may offer you the ability to register and log in using your third-party social media account details (like your Epic Games account login). Where you choose to do this, I will receive certain profile information about you from your media provider. The profile information I receive may vary depending on the media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a media platform.
I will use the information I receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the relevant Services. Please note that I do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. I recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
Financial Data
My games are exclusively released on Itch.io. Some may be free while others may require payment. I do not process payments. Itch.io processes all purchases and payments on my behalf. I may receive from Itch.io your username or account name and confirmation that you "own" a specific game. Please see Itch.io's Privacy Policy and Terms for what information the collect and share and also what it means to "own" a game purchased from Itch.io.
5. Use of Data
I may use the collected data for various purposes:
- to provide and maintain my Service;
- to notify you about changes to my Service;
- to allow you to participate in interactive features of my Service when you choose to do so;
- to provide customer support;
- to gather analysis or valuable information so that I can improve my Service;
- to monitor the usage of my Service;
- to detect, prevent and address technical issues;
- to fulfill any other purpose for which you provide it;
- to carry out my obligations and enforce my rights arising from any contracts entered into between you and me, including for billing and collection;
- to provide you with notices about your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;

6. Retention of Data
I will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. I will retain and use your Personal Data to the extent necessary to comply with my legal obligations (for example, if I are required to retain your data to comply with applicable laws), resolve disputes, and enforce my legal agreements and policies.
I will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period (3 to 7 days), except when this data is used to strengthen the security or to improve the functionality of my Service, or I are legally obligated to retain this data for longer time periods.

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

I may disclose personal information that I collect, or you provide:
- Disclosure for Law Enforcement.
- Under certain circumstances, I may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.
- Other cases. I may disclose your information also:
- to fulfill the purpose for which you provide it;
- with your consent in any other cases;
- if I believe disclosure is necessary or appropriate to protect the rights, property, or safety of the myself or others.

The security of your data is important to me but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While I strive to use commercially acceptable means to protect your Personal Data, I cannot guarantee its absolute security.

11. Your Data Protection Rights under the California Privacy Protection Act (CalOPPA)
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivable the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.

I may employ third party companies and individuals to facilitate my Service (“Service Providers”), provide Service on my behalf, perform Service-related services or assist me in analyzing how my Service is used.
These third parties have access to your Personal Data only to perform these tasks on my behalf and are obligated not to disclose or use it for any other purpose.

My Services are not intended for use by children under the age of 13 (“Child” or “Children”).

I may update my Privacy Policy from time to time. I will notify you of any changes by posting the new Privacy Policy on this page.
